1. Using our website
You may browse our website and sign up for updates. Please don't misuse it. That means not trying to break or overload it, gain access you aren't given, or send us anything unlawful or harmful.
The website's content is for general information. It isn't professional advice, and it may change without notice.
2. Our services to clients
We provide marketing services and access to our platform under a written agreement with each client, such as a proposal, statement of work or contract. That agreement sets out what we do, fees, responsibilities and liability. If it conflicts with these terms, the client agreement wins.
3. Accounts you connect to our platform
When a client connects an advertising account (e.g. Meta, Google Ads, TikTok, Amazon Ads, ChatGPT Ads) or an online store (e.g. Shopify):
- the client confirms they have the right to give us that access;
- we use it only to report on and run the client's marketing, as agreed with them;
- no advertising budget is spent without approval from an authorised person at OWN, within limits agreed with the client;
- the client can remove our access at any time, from the platform concerned or by asking us;
- each platform's own terms still apply to the client's account, including Meta's, Google's, TikTok's, Amazon's, OpenAI's and Shopify's.
How we handle personal data is explained in our privacy policy.
4. Intellectual property
Our website, brand and platform belong to Adaptiv Limited or our licensors. Ownership of work we create for clients is set out in each client agreement.
5. Third-party links and services
Our website and services link to, and rely on, services run by others. We aren't responsible for their content or for how they operate.
6. Liability
Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud.
Otherwise, for use of the website itself, which is free, we aren't liable for indirect or consequential loss, or for loss of profit, revenue or data. For our services, liability is as set out in the client agreement.
7. Changes
We may update these terms. The date at the top shows when they last changed.
8. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
